§ 12.54.010. Nonstandard vehicles.

  • A.

    A nonstandard vehicle as referred to in this chapter is one which is used for for-hire transportation services provided in the public right-of-way, but has not been licensed by the State of Maryland, or cannot maintain the posted traffic speeds, and whose service is not regulated by the State of Maryland. All nonstandard vehicles other than those designated as personal assistive devices must obtain a nonstandard vehicle permit prior to operating on any public rights-of-way.

    B.

    The Director of Transportation shall not issue a nonstandard vehicle permit until the following requirements have been satisfactorily met by the provider of the nonstandard vehicle service:

    1.

    Provided documentation of off-street storage, boarding, and alighting areas to adequately provide the service with minimal impact on traffic flow and the public right-of-way.

    2.

    Provided a description of the routes or service area and identified hours of operation.

    3.

    Provided documentation of compliance with Federal and State Transportation Regulations.

    4.

    Provided documentation of compliance with all Federal, Maryland, and Annapolis permitting processes.

    5.

    Provided insurance certificates including, but not limited to, personal and property liability, municipal hold-harmless certificate and Workmen's Compensation for any employees. Further, proof of insurance must include that the City shall be held harmless and included as an added insured on said insurance. Coverage shall consist of liability insurance in the amount of five hundred thousand dollars.

    6.

    Passed an Annapolis Department of Transportation inspection of safety, personal comfort and cleanliness features, including as applicable, but not limited to, signal, brake, tail and head lights; brakes and suspension; driver and passenger seats; and special devices for animal safety and hygiene.

    7.

    Provided a system for dealing with any liquid waste produced by the animal that is acceptable to the Department of Transportation.

    C.

    New and renewed nonstandard vehicle permits shall be issued annually for the period through June 30th. The fees for such permits shall be as established by resolution of the City Council.

    D.

    All vehicles which cannot maintain posted traffic speeds must have their routes approved in advance by the Annapolis Department of Transportation through its permitting process for the nonstandard vehicle permits, approved routes shall be restricted to low traffic volume streets where the faster cars, trucks and emergency vehicles are able to safely pass the slower vehicle.

    E.

    Hours of operation in residential areas should be minimized and not create a disturbance to residents. Operations in residential areas between 10:00 p.m. and 8:00 a.m. are prohibited.

    F.

    If the service is to be provided not more than three times within a calendar year or will be provided only on a contractual basis and not open to the public, the provider must obtain a special event permit from the special events coordinator. If the service operates more than three times during a calendar year and is open to the public, the provider must obtain a nonstandard vehicle permit from the Department of Transportation and any operators of the vehicle must obtain a nonstandard vehicle operator's permit.

    G.

    Each vehicle shall prominently display its nonstandard vehicle permit along with its passenger capacity and schedule of rates.
