§ 16.16.160. Discharge permits.

  • A.

    Mandatory. All significant industrial users discharging or proposing to discharge into a public sewer must obtain a wastewater discharge permit before discharging or proposing to discharge into a public sewer. In addition to significant industrial users obtaining a wastewater discharge permit the City has the authority to permit any other class of industries or any other industry as deemed appropriate by the department.

    B.

    Application. Users discharging or proposing to discharge into a public sewer shall complete and file with the director, a wastewater discharge permit application acceptable to and in the form prescribed by the Director of Public Works, and accompanied by the applicable fees as established by resolution of the City Council.

    C.

    Conditions. Wastewater discharge permits shall be subject to all provisions of this article and all other regulations, user charges and fees established by the City. All applicable conditions shall be stated in the discharge permit. At a minimum these shall include the following:

    1.

    Effective and expiration dates;

    2.

    Statement of nontransferability as specified in Ordinance Section 90-47G;

    3.

    Effluent limitations based on applicable general pretreatment standards, categorical pretreatment standards, local limits, and/or State and local law;

    4.

    Self-monitoring, sampling, reporting, notification and recordkeeping requirements, including an identification of the pollutants to be monitored, sampling location, sampling frequency and sample type, based on the applicable general pretreatment standards, categorical pretreatment standards, local limits, and/or State and local law; and

    5.

    Statement of applicable civil and criminal penalties for violation of pretreatment standards and requirements, and any applicable compliance schedule. Such schedule may not extend the compliance date beyond applicable Federal deadlines.

    D.

    Transfer. Wastewater discharge permits are issued to a specific user for a specific operation. A wastewater discharge permit shall not be reassigned or transferred or sold to a new owner, new user, different premises, or a new or changed operation.

    E.

    Revocation. Any user who violates the following conditions of the permit or of this article, or applicable State and Federal regulations, is subject to having the permit revoked:

    1.

    Failure of a user to report factually the wastewater constituents and characteristics of the discharge;

    2.

    Failure of the user to report significant changes in operations, or wastewater constituents and characteristics;

    3.

    Refusal of reasonable access to the user's premises for the purpose of inspection or monitoring; or

    4.

    Violation of conditions of the permit.

    F.

    Limited Duration. A wastewater discharge permit may be issued for any term of five years or less. All permits will be issued for a limited duration. A user must submit a permit application ninety days prior to the expiration date of the permit. In the event that a timely and sufficient reapplication has been submitted and the City is unable, through no fault of the user, to issue a new permit before the expiration date of the permit, the terms and conditions of the permit are automatically continued and remain fully effective and enforceable.

    G.

    Modification. A wastewater discharge permit may be modified for good cause, including but not limited to, the following reasons: (1) to incorporate any new or revised Federal, State, or local pretreatment standards or requirements; (2) to address significant alterations or additions to the user's operations, processes, or wastewater volume or character since the time of wastewater discharge permit issuance; (3) a change in the POTW that requires either a temporary or permanent reduction or elimination of the authorized discharge; (4) information indicating that the permitted discharge poses a threat to POTW personnel, or the receiving waters; (5) violation of any terms or conditions of the wastewater discharge permit; (5) misrepresentations or failure to fully disclose all relevant facts in the wastewater discharge permit application or in any required reporting; or (6) to correct typographical or other errors in the wastewater discharge permit.
